US Judge Mandates Release of Abrego Garcia from ICE Detention

A federal judge has ordered the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement is without lawful basis.

"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.

The case originates in a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an mistake. Following his return to the United States to face alien smuggling allegations, he was held in federal custody.

In her order, the judge noted that the authorities does not have a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."

Background of the Case

The legal proceedings center on disputed assertions. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this claim.

He has also entered a not guilty plea to the conspiracy charges, which are part of a separate trial in Tennessee.

Conditions of Freedom

The judge, who was overseeing his challenge to deportation in a Maryland district court, ruled that he must now comply with the terms of his bond from jail in Tennessee. This decision effectively transfers his supervision to the Tennessee court.
